TERMS AND CONDITIONS
The Sanctuary

These general terms and conditions apply to all events organised by The Sanctuary.

ARTICLE 1: DEFINITIONS

  1. Participant: the natural person who participates.

  2. Executor: The Sanctuary

  3. Event: any event offered by The Sanctuary.

  4. Damage: all claims, damages and costs that are in any way related to or arising from the assignment.

ARTICLE 2: THE AGREEMENT

  1. The General Terms and Conditions apply to all activities organised during an event.

  2. The moment the participant indicates that he or she wishes to register for an event, the participant agrees to these General Terms and Conditions and to the payment of the amount due for the relevant event.

  3. Participation in the event organised by The Sanctuary during the event is entirely at the participant's own risk.

  4. The participant is obliged to report physical complaints to the organiser before the start of the event. Participation is only possible if your health is not an obstacle. If in doubt, contact your treating physician and/or physiotherapist. Even in case of operations in the past, chronic complaints or doubts, always consult a doctor/specialist before registering for an event.

ARTICLE 3: PARTICIPATION

  1. A Participant can participate in the event after he/she has registered in advance with The Sanctuary and has paid the costs as agreed. Registration can be done by email via info@thesanctuary.center

  2. A place for the event is only guaranteed for the Participant after the Participant has received payment of the registration fee and has sent an email confirming participation to the Participant.

ARTICLE 4: PAYMENT

  1. Participant can book an event via The Sanctuary's website and make a payment.

  2. After registering for an event via email, the costs must be paid to The Sanctuary's account no later than 7 days after registration, stating: name and relevant dates of the event.

  3. In the event of late payment, The Sanctuary has the right to cancel the reservation.

  4. The Sanctuary provides a clear overview of what is included in the event.

ARTICLE 5: CANCELLATION BY PARTICIPANT

  1. Cancellation of participation in the event can be done by email to info@thesanctuary.center and is valid after confirmation of cancellation from The Sanctuary. In the event of cancellation of participation, the following applies:

  2. The Participant can cancel his registration up to 60 days before the start of the event, in which case 25% of the costs will be charged plus a Euro 50 administration fee. If, after consultation with The Sanctuary, the Participant transfers his reservation to another Event, only Euro 50 administration costs will be charged.

  3. Within 60 days to 45 days before the start of the event, the Participant can cancel his registration, in which case 50% of the costs will be charged plus a Euro 50 administration fee. If, after consultation with The Sanctuary, the Participant transfers his reservation to another Event, 25% of the costs will be charged.

  4. If the Participant cancels his registration within 45 days before the start of the event, 100% of the costs will be charged. If, after consultation with The Sanctuary, the Participant transfers his reservation to another Event, 50% of the costs will be charged.

  5. If the Participant cannot participate in the event on site, for whatever reason, the costs already paid will not be refunded.

  6. If the Participant is unable to attend the event booked by him or her, substitution is permitted, but only after consultation and agreement with The Sanctuary.

  7. If the number of participants is transferred, participation may be moved to the next event. The Sanctuary can at that time opt for reimbursement of the contribution.

  8. Participation in the program during the event is on a voluntary basis. Cancelling from participation in the program does not entitle the Participant to a (partial) refund of the costs already paid nor a right to a replacement activity.

  9. Participants can take out (continuous) travel and/or cancellation insurance with an insurer to cover unforeseen costs of cancellation. Please check the cancellation conditions of your insurance.

ARTICLE 6: CANCELLATION AND CHANGES BY THE SANCTUARY

  1. The Sanctuary reserves the right to cancel an event if there are justified reasons, including insufficient registrations, illness of the trainer or force majeure (such as an outbreak of a pandemic or tightened Corona measures). In the event of the above, the costs already paid by the Participant will be fully transferred to a subsequent event or refunded by The Sanctuary.

  2. The Sanctuary reserves the freedom to change the General Terms and Conditions at any time.

  3. The Sanctuary is not obliged to fulfil any obligations if they are prevented from doing so as a result of force majeure (a circumstance that is not due to fault, and is not their responsibility under the law, a legal act or generally accepted views). An example of force majeure is weather conditions. For example, in bad weather conditions, a planned outdoor activity may not take place. In this case, the implementers will offer a replacement activity if desired.

ARTICLE 7: LIABILITY AND RISK ACCEPTANCE

  1. The Sanctuary undertakes to carry out the event to the best of his knowledge and ability.

  2. The Sanctuary is not responsible for damage and/or loss of the participant's property on location, nor for any form of physical injury during the event. Participant takes part in the event at his own risk and will not be entitled to any rights arising from Article 6:179 of the Dutch Civil Code with regard to the Executor.

  3. The Sanctuary disclaims all liability for any illness, injury, death, property loss or damage caused (in part) by any misinformation provided by Participant to the Sanctuary or caused by not (fully) following instructions provided by the Sanctuary to Participant

  4. Participant is aware that as a result of the innovative services provided by The Sanctuary, The Sanctuary's liability is limited to reasonable, direct damage actually suffered by Participant, with a liability limit of the amount paid by the Participant to The Sanctuary has paid for the specific service provided by The Sanctuary to the Participant. Under no circumstances will The Sanctuary be liable for any indirect, special, punitive, accidental or consequential damages.

  5. By participating in the event, the Participant expressly agrees to the above.

ARTICLE 8: PRIVACY

  1. The registration of personal data is treated strictly confidential and not passed on to third parties.

ARTICLE 9: FEEDBACK & COMPLAINTS PROCEDURE

  1. If you are not satisfied with our services or have a complaint, we will do everything we can to discuss it as quickly as possible and see how we can resolve the complaint together. All feedback and complaints can be emailed to: info@thesanctuary.center

  2. As soon as we have received your complaint, you will receive a response within 2 weeks. We aim to have the complaint resolved within 4 weeks. If more time is needed, you will be notified. Your complaint will be treated confidentially at all times.

ARTICLE 9: APPLICABILITY AND DISPUTES

  1. These conditions apply to all agreements with The Sanctuary regarding participation in events or advice in the broadest sense of the word.

  2. Deviations from this agreement are only binding if they have been confirmed in writing by The Sanctuary.

  3. All disputes will be submitted to the Court in the location or vicinity of The Sanctuary’s location in the Netherlands. Agreements & contracts entered between the Participant and The Sanctuary are subject only to Dutch law.
