TERMS AND CONDITIONS
The Sanctuary
Welcome! These Terms and Conditions apply to all events, retreats, ceremonies, workshops, training, educational programs and other activities organized by The Sanctuary. By registering, the Participant agrees to these terms and conditions.
ARTICLE 1: DEFINITIONS
In these Terms and Conditions, the following definitions apply:
Organizer: The Sanctuary, located in the Netherlands.
Participant: the person who registers for or participates in an Event.
Event: any retreat, ceremony, workshop, training, course, coaching session, or other activity organized by The Sanctuary.
Contribution: the amount paid by the Participant for attending an Event.
ARTICLE 2: THE AGREEMENT
The Agreement is concluded as soon as the Participant registers for an Event.
By registering, the Participant agrees to these Terms and Conditions.
Deviations from these Terms and Conditions are only valid if confirmed in writing by The Sanctuary.
The Sanctuary may refuse a registration without giving any reason.
ARTICLE 3: REGISTRATION, PAYMENT AND CONFIRMATION
The agreement between the Participant and The Sanctuary is concluded at the moment the Participant registers for an Event via the website or makes a booking by other means. By registering, the Participant declares that they agree to these Terms and Conditions.
A place for an Event is only definitively reserved once The Sanctuary has received the (advance) payment and the registration has been confirmed in writing by e-mail. The cancellation conditions outlined in Article 4 apply from the moment of registration. Until written confirmation is provided, The Sanctuary reserves the right to cancel the agreement if placement is reasonably not possible, for example due to capacity limitations or other compelling circumstances.
For Events requiring a medical screening and/or intake interview, admission to participate depends on the completion of this screening and the absence of contraindications.
If the medical screening or intake shows that participation is not advisable for health or safety reasons, The Sanctuary reserves the right to deny the Participant access. In that case, the already paid contribution will be refunded, minus any reasonable administrative costs.
If the Participant decides to cancel before the completion of the intake or screening, the regular cancellation terms remain fully applicable.
The Participant participates voluntarily and entirely at their own risk in the Event. The Participant must pay the due Contribution within the agreed term. In case of late payment, The Sanctuary may cancel the registration.
Prices listed include VAT unless otherwise stated. Any additional costs, such as accommodation or transportation, are the responsibility of the Participant.
ARTICLE 4: CANCELLATIONS AND RESCHEDULING
The Sanctuary invests time, energy, and resources to ensure a safe and valuable experience for all participants. Our Events are prepared with great care and attention, with planning and group composition being essential. To maintain this quality, the following cancellation policy has been carefully established.
4.1 Cancellation by Participant
If the Participant wishes to cancel their participation in an Event, this must be communicated to The Sanctuary in writing.
In the event of cancellation, there is no right to a refund of the registration fee or participation contribution.
If the Participant has not paid the full participation contribution at the time of registration, they remain responsible for paying the remaining amount unless otherwise agreed in writing with The Sanctuary. This also applies in the case of rescheduling participation to another Event, in addition to any extra costs for rescheduling.
4.2 Rescheduling to Another Event
If the Participant cancels their participation in an Event, the participation may, after consultation with The Sanctuary, be rescheduled to an Event of their choice within 12 months, counted from the date of cancellation.
The participation contribution already paid for the originally booked and canceled Event remains valid and will be applied toward participation in the newly chosen Event.
In addition, a rescheduling fee is payable, calculated as a percentage of the participation contribution of the originally booked Event, according to the following schedule:
Cancellation before start. Rescheduling Fee
More than 60 days. 25% of the contribution
60 – 15 days. 50% of the contribution
Less than 15 days. 75% of the contribution
If the newly chosen Event has a higher participation contribution than the originally booked Event, the Participant must additionally pay the difference in Contribution.
If the newly chosen Event has a lower participation contribution than the originally booked Event, the remaining amount can be applied by the Participant toward future Events with The Sanctuary within 12 months.
4.3 No-show
In case of non-attendance, no refund will be issued.
4.4 Opting Out of Program
Participants are always allowed to skip parts of the program, but this does not entitle them to any refund or compensation.
4.5 Transfer of Participation
The Participant is not allowed to transfer their place to a third party.
4.6 Advice on Travel and/or Cancellation Insurance
Participants are advised to take out a (continuous) travel and/or cancellation insurance policy with an insurer of their choice to cover any unforeseen costs resulting from cancellation or rescheduling. Please check the terms and conditions of your insurance policy.
ARTICLE 5: CHANGES OR CANCELLATION BY THE SANCTUARY
The Sanctuary reserves the right to cancel or reschedule an Event for valid reasons. These include, but are not limited to:
- Insufficient registrations;
- illness or unavailability of the facilitator or trainer;
- force majeure, including natural disasters, pandemics, government measures, extreme weather conditions, or other circumstances beyond the control of The Sanctuary;- issues with the rented location, including the risk that the location is sold, closed, or otherwise unavailable;
- transport or delivery problems;
- other circumstances beyond our reasonable control.
In case of cancellation or rescheduling, amounts already paid will be applied to an Event of choice within 12 months. If the new Event has a higher participation fee than the originally booked Event, the Participant must pay the difference in participation fee. If the new Event has a lower participation fee than the originally booked Event, the remaining balance may be used by the Participant for future Events at The Sanctuary within 12 months.
There is no entitlement to a refund.
Program, schedule, location, or facilitators may be adjusted; this does not entitle the Participant to a refund.
Participation in an Event remains voluntary and at the Participant’s own risk, even in the case of changes or rescheduling as described above.
If the maximum number of participants for an Event is reached, The Sanctuary may move the Participant to the next available Event of choice. The Participant who cannot attend the alternative Event is entitled to a refund of the amount already paid.
Participants are advised to take out a (continuous) travel and/or cancellation insurance with an insurer of their choice to cover any unforeseen costs due to cancellation or changes. Please check the terms and conditions of your insurance.
ARTICLE 6: HEALTH, SAFETY AND USE OF PSYCHEDELICS
6.1 Use of psychedelics
Some Events may involve the use of psychedelics. The Participant engages in these activities voluntarily and at their own risk, and must strictly follow the instructions of the facilitators. It is the responsibility of the Participant to ensure that participation is medically safe and that no contraindications are present.
6.2 Contraindications and medication
The Participant may not take part in an Event involving psychedelics if there are medical contraindications or if the Participant uses medication that may constitute a contraindication. It is the Participant’s responsibility to discuss this with a doctor or specialist prior to the Event.
6.3 Medical intake and screening
For Events involving psychedelics, an intake and medical screening are mandatory. Participation can only take place once the intake and screening have been completed by The Sanctuary and no contraindications have been identified.
6.4 Voluntariness and personal responsibility
The Participant decides for themselves whether to take part in activities and may voluntarily abstain from participation in parts of the program at any time. Choosing not to participate does not entitle the Participant to a refund or replacement activities.
6.5 Safety and guidance
The Sanctuary strives to provide a safe environment and competent guidance. The Participant must follow instructions and is responsible for adhering to safety guidelines. Any risks associated with participation are the Participant’s responsibility.
6.6 Participant declaration
By participating, the Participant declares that they:
are at least 18 years old;
have provided all requested medical information truthfully;
are physically and mentally fit to participate in the Event;
are aware of the risks associated with participation and fully accept responsibility for their own health and safety.
6.7 No replacement for medical care
The Events of The Sanctuary are not medical treatments and do not replace professional medical advice. The Participant remains responsible for their own health at all times and should consult a doctor or medical specialist if in doubt or in case of (chronic) health issues before participating in an Event.
ARTICLE 7: LIABILITY AND RISK
1. Event execution
The Sanctuary commits to carrying out the Event to the best of its knowledge and ability.
2. Personal risk
The Sanctuary is not responsible for damage to or loss of the Participant’s belongings on site, nor for any form of physical injury during the Event. The Participant participates in the Event at their own risk and will not make any claims against The Sanctuary based on rights arising from Article 6:179 of the Dutch Civil Code.
3. Limitation of liability
The Sanctuary disclaims all liability for damage or loss caused by:
a. incorrect or incomplete information provided by the Participant;
b. failure to follow instructions or guidelines given by The Sanctuary to the Participant;
c. indirect, consequential, special, punitive, or incidental damages.
4. Events with psychoactive substances
The Participant acknowledges that participation in Events involving psychoactive substances carries risks. The Participant is responsible for following the facilitators’ instructions and adhering to medical advice as determined during the intake and screening. The Sanctuary is not liable for any damage or injury resulting from the use of psychoactive substances during the Event.
5. Maximum liability
The Participant is aware that, as a result of the services provided by The Sanctuary, The Sanctuary’s liability is limited to reasonable, direct damages, with a liability cap equal to the amount the Participant has paid to The Sanctuary for the specific service provided by The Sanctuary. Under no circumstances is The Sanctuary liable for any indirect, special, punitive, accidental, or consequential damages.
6. Indemnification
The Participant indemnifies The Sanctuary against claims by third parties arising from participation in the Event. This means that the Participant will cover all reasonable costs, damages, and claims submitted by third parties due to actions or negligence of the Participant and will hold The Sanctuary harmless.
7. Acceptance
By participating in the Event, the Participant expressly agrees to the above and accepts personal responsibility and the risks associated with participation.
ARTICLE 8: CONDUCT AND SAFETY
The Participant must follow all instructions and take responsibility for their own safety.
In cases of dangerous, inappropriate, or disruptive behavior, participation may be immediately terminated without refund.
Participants are expected to behave respectfully and responsibly toward themselves, others, and the environment. Rules regarding safety, health, and psychoactive substances are mandatory.
If these rules are violated, The Sanctuary may decide to remove the Participant from the Event. In such cases, there is no entitlement to a refund.
This includes, among other things, that the Participant does not use psychoactive substances outside the prescribed setting, follows the instructions of the facilitators, and respects the safety of themselves and others. In this way, a safe and respectful experience is collectively ensured.
ARTICLE 9: PRIVACY
The registration of personal data is treated with strict confidentiality and will not be shared with third parties.
ARTICLE 10: INTELLECTUAL PROPERTY
All content, materials, methodologies, exercises, music, courses, trainings, workshops, and other materials used or provided by The Sanctuary are the intellectual property of The Sanctuary. Participants or third parties are not permitted to copy, reproduce, distribute, publicly perform, or use these contents, materials, or methodologies in any other way—commercially or non-commercially—without prior written permission from The Sanctuary, including offering their own ceremonies or trainings derived from them.
ARTICLE 11: FEEDBACK & COMPLAINTS PROCEDURE
If the Participant is not satisfied with the services of The Sanctuary or has a complaint, The Sanctuary will make every effort to engage in consultation as soon as possible and jointly reach an appropriate solution. Complaints and feedback can be submitted in writing via: info@thesanctuary.center
The Sanctuary will carefully review each complaint and provide a response within a reasonable timeframe.
Submitting a complaint does not release the Participant from their obligations under these Terms and Conditions or from participation in the Event.
The Sanctuary reserves the right to handle a complaint in an appropriate manner, including consultation with the Participant, adjustment of services, or other reasonable measures.
ARTICLE 12: APPLICABILITY & DISPUTES
These terms and conditions apply to all agreements with The Sanctuary regarding participation in events, as well as advice in the broadest sense.
Deviations from this agreement are only binding if they have been confirmed in writing by The Sanctuary.
All disputes will be submitted to the Court in the location or vicinity of the Executor’s office in the Netherlands. Only Dutch law applies to agreements concluded between the Participant and The Sanctuary.
